  3. Each Product presented in the Store has a description of its main features, in particular: type, size (where applicable), material and other relevant properties enabling the Customer to make an informed choice.
  4. Information presented in the Store, in particular Product descriptions, prices and availability, constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Polish Civil Code and does not constitute an offer within the meaning of the law.
  5. Orders can be placed 24 hours a day, 7 days a week, using the Order Form available on the Store’s website.

    3. does not include delivery costs, which are shown separately before the Order is placed.
  8. The total price of the Order (Product + delivery) is always shown to the Customer before final confirmation.

§ 4. Conclusion of the sales contract

  1. A Sales Contract between the Customer and the Seller is concluded when the Customer places an Order and the Seller accepts it.
  2. Placing an Order constitutes an offer to the Seller to conclude a Sales Contract on the terms set out in the Product description and in these Terms and Conditions.
  3. After the Order is placed, the Seller promptly confirms its receipt by e-mail.
  4. Confirmation of receipt of the Order means that the Customer is bound by their offer.
  5. The e-mail referred to in section 3 contains in particular:
    1. confirmation of the essential elements of the Order,
    2. these Terms and Conditions,
    3. information on the right to withdraw from the contract and a model withdrawal form.
  6. The Sales Contract between the Customer and the Seller is concluded when the Customer receives the e-mail confirming that the Order has been accepted for fulfilment.
  7. The Sales Contract is concluded in Polish.
  8. Each Sales Contract is confirmed by a proof of purchase (receipt or VAT invoice), delivered with the Product or electronically.

§ 5. Prices and payment methods

  1. All prices in the Store are gross prices in Polish zloty (PLN) and include VAT.
  2. Product prices do not include delivery costs, which are always shown to the Customer before the Order is placed and in the Order summary.
  3. The price binding on the Customer is the price in force when the Order is placed.
  4. The Seller reserves the right to change Product prices; such changes do not affect Orders placed before they were introduced.
  5. Available payment methods include in particular:
    1. electronic payments handled by the operator Przelewy24,
    2. BLIK payments,
    3. card payments,
    4. Apple Pay,
    5. Google Pay.
  6. The Customer must pay promptly, no later than 7 days from the conclusion of the Sales Contract, unless the payment system indicates otherwise.
  7. If payment is not received within the required time, the Seller may:
    1. suspend fulfilment of the Order,
    2. cancel the Order after an unsuccessful request for payment.
  8. Fulfilment of the Order begins once the payment has been credited or positively confirmed by the payment operator.
  9. Discounts and promotions that depend on buying specific Products or a specific number of them (in particular the “THE IQONE Duo” discount on the second, cheaper T-shirt and a discount on a Product granted when another Product is purchased) apply as long as the Order contains Products that meet the conditions of the promotion. The consequences of returning some of the Products are set out in § 8(10)–(12).
  10. The pre-order price of a Product marked in the Store as available for pre-order applies until the pre-order end date stated on the Product page. Discount codes do not apply to pre-order Products unless the terms of a given code provide otherwise.

§ 6. Delivery

  1. Products are delivered within the Republic of Poland and to selected European Union countries.
  2. Delivery is made by courier companies and via the InPost Parcel Locker network or other available logistics operators indicated during the ordering process.
  3. The total Order fulfilment time consists of:
    1. the time needed to prepare the Order for shipment (picking and packing),
    2. the delivery time of the carrier.
  4. The standard time to prepare and dispatch an Order is up to 24 hours on business days, counted from when the payment is credited, subject to sections 9–11.
  5. Standard delivery time:
    1. within Poland: 1 to 2 business days from dispatch,
    2. within the European Union: 2 to 7 business days from dispatch.
  6. Deliveries are made on business days only, excluding Saturdays, Sundays and public holidays.
  7. Delivery costs are always shown to the Customer while placing the Order and before final confirmation, and depend on the chosen delivery method and the destination country.
  8. The Seller exercises due care in selecting carriers but is not liable for delays caused solely by extraordinary, unforeseeable events (force majeure).
  9. Products marked in the Store as available for pre-order are dispatched by the Seller from the shipping start date stated on the Product page, in the cart and in the Order confirmation. The time limit referred to in section 4 does not apply to such Products.
  10. An Order that includes a pre-order Product is shipped by the Seller in full, in a single shipment, from the shipping start date of that Product, even if the Order also includes Products available immediately. A Customer who wants to receive an in-stock Product earlier places a separate Order.
  11. If the Seller cannot dispatch a pre-order Product on the date indicated in accordance with section 9, it promptly informs the Customer by e-mail and gives a new date. The Customer may then withdraw from the contract with respect to that Product, and the Seller refunds the price paid promptly, no later than within 14 days.

§ 7. Complaints (conformity of goods with the contract)

  1. The Seller is liable to the Consumer and to the Entrepreneur with consumer rights for any lack of conformity of the Product with the contract for 2 years from its delivery.
  2. If the Product is found not to conform with the contract, the Customer may first demand:
    1. repair of the Product, or
    2. replacement of the Product with a new one.
  3. If repair or replacement is impossible, excessively difficult, or the Seller does not carry them out within a reasonable time, the Customer may demand:
    1. a price reduction, or
    2. withdrawal from the contract.
  4. If a lack of conformity becomes apparent within 1 year of delivery, it is presumed to have existed at the time of delivery.
  5. Complaints can be submitted:
    1. by e-mail to: kontakt@theiqone.com,
    2. in writing to: ul. Mostowa 22, 42-400 Zawiercie, Poland.
  6. A complaint should contain at least:
    1. a description of the non-conformity,
    2. the Customer’s details,
    3. the Customer’s request.
  7. The Seller handles a complaint within 14 days of receiving it.
  8. If the complaint is justified, the Seller bears the costs of delivering and returning the Product.

§ 8. Withdrawal from the contract

  1. The Consumer and the Entrepreneur with consumer rights may withdraw from the Sales Contract within 30 days without giving any reason. The 30-day period is a contractual period offered by the Seller, longer than the statutory 14 days.
  2. The withdrawal period runs from the day on which the Customer, or a third party indicated by them, takes possession of the Product.
  3. To exercise the right of withdrawal, the Customer must send the Seller an unequivocal statement of withdrawal from the contract.
  4. The statement may be submitted in particular:
    1. by e-mail to: kontakt@theiqone.com,
    2. in writing to the Seller’s address.

Effects of withdrawal

  1. In the event of an effective withdrawal, the contract is deemed not to have been concluded.
  2. Subject to sections 10–12, the Seller refunds all payments received from the Customer, including the cost of the cheapest standard delivery method offered in the Store.
  3. The refund is made no later than 14 days from the day the statement of withdrawal is received.
  4. The Seller may withhold the refund until it has received the Product back or the Customer has supplied proof of having sent it back.
  5. The Customer bears the direct cost of returning the Product.
  6. If the Customer used a discount or promotion referred to in § 5(9) and then, within the 30-day period referred to in section 1, withdraws from the contract with respect to some of the Products in such a way that the Products they keep no longer meet the conditions of the promotion, the discount is recalculated.
  7. Recalculation means that the Customer pays for the Products they keep the amount they would have paid if they had ordered only those Products, under the promotion terms in force on the day the Order was placed. The Seller recalculates automatically and deducts the difference from the refund amount. Recalculation applies only to the Product discount and does not cover delivery costs.
  8. Recalculation of the discount does not apply to the return of a Product in connection with a complaint, a defect of the Product or an error by the Seller (in particular sending the wrong size or colour), nor to the exchange of a Product for another size of the same Product.

Size exchange

Within the 30-day period referred to in section 1, instead of a refund, the Customer may exchange the Product for another size of the same Product. The Customer bears the cost of sending the Product back to the Seller. The Seller covers the cost of shipping the new size to the Customer, for one exchange per Order and only for the same Product model; a further exchange or an exchange for a different model is possible as a return and a new Order. The new size is sent once the returned Product has been received; if the chosen size is out of stock, the Seller refunds the payment. If the exchange results from a complaint or an error by the Seller, the Seller bears the cost of both shipments. Details: Returns and Complaints Policy, § 1a.

Exceptions to the right of withdrawal

  1. The right of withdrawal does not apply in the cases set out in applicable law, in particular to:
    • Products made to the Customer’s individual order,
    • clearly personalised Products.

§ 9. Entrepreneur with consumer rights

  1. An entrepreneur who is a natural person and makes a purchase in the Store for a purpose not directly related to their business or professional activity (an Entrepreneur with consumer rights) enjoys the protection provided for Consumers, to the extent set out in applicable law.
